PRIVACY POLICY FOR BODY BIKE INDOOR CYCLING APP BODY BIKE is strongly committed to protecting the privacy of our users and we do not collect or share personal information entered into the mobile application. This is a first and very important condition to safeguard your privacy. If personal information isn’t collected, it can’t be stolen, demanded, leaked or exposed. We do provide you with the opportunity of sharing your data via Strava in which you will have to create an account. The privacy policy and terms of Strava applies to this. TERMS & CONDITIONS FOR BODY BIKE INDOOR CYCLING APP Please read the terms and conditions of this end user license agreement (“EULA”) carefully before downloading, installing or using the mobile app provided to you by BODY BIKE International. This is a legal agreement between you and BODY BIKE. This agreement and the BODY BIKE Privacy Policy govern your access to and use of the mobile application. By downloading, installing or using the app you acknowledge and agree that: 1. Your use of the app is solely at your own risk; 2. The app is licensed, not sold to you and you may use the app only as set forth in this EULA; 3. The app is provided on a “AS IS” basis meaning that the information, services and content in the app is provided to you “as is” and without warranty. BODY BIKE and our employees, agents, partners and licensors hereby disclaim all warranties with regard to such information, services and content including, without limitation, all implied warranties. BODY BIKE and our employees, agents, partners and licensors make no warranty that 1) The service will meet your requirements; 2) the service will be uninterrupted, timely, secure or error-free; 3) the results that may be obtained from the use of the service will be accurate or reliable; 4) the quality of any service or information obtained by you through the service will meet your expectations; and 5) any errors in the application will be corrected. Additionally, BODY BIKE and our employees, agents, partners and licensors take no responsibility for loss of recorded training data; 4. Your physical activities associated with the services provided by our app carry certain significant risks of property damage, bodily injury or death, and that BODY BIKE and our employees, agents, partners and licensors do not assume responsibility for any known or unknown risks associated with these activities; 5. By downloading, installing and using the app, you agree to follow and be bound by the Terms, which may be updated by BODY BIKE from time to time without notice to you. BODY BIKE may make improvements and/or changes in the application at any time without notice; 6. BODY BIKE provides you with a mobile application that records your workout data. This data will be stored in your phone, not to be collected and shared by BODY BIKE or any third party unless authorised by the user; 7. Any action related to our mobile application and the Content or these Terms shall be governed by Danish federal law. WARRANTY OBLIGATIONS As information to our customers we hereby outline the warranty obligations applicable to BODY BIKE Indoor Cycles. The warranty comes into force the moment the unit leaves BODY BIKE International A/S. Any part not mentioned below is not covered by warranty. This means that consumable items (including, but not limited to, the SMART Release handles, adjustment handles, the Poly V-belt, brake pad, handlebar rubber, saddle, silicone generator wheel) which are subject to continuous wear and tear, are not covered by warranty. The warranty covers failures as a result of a manufacturing fault and occurred during normal use. It does not extend to faults resulting from misuse, abuse, damage incurred during loading, transportation or improper storage, or where the indoor cycle has been used other than as recommended by BODY BIKE, or modified without BODYBIKE’s consent. The cycles are made for indoor use in a well-ventilated room. Do not place the cycles outdoors or in a high humidity environment like near a swimming pool. The warranty only applies to cycles equipped with original BODY BIKE spare parts. All warranties are cancelled if the cycle has been modified or in any way not used as intended. Over time sunlight and other environmental impacts will affect the plastic and rubber parts. Hardened rubber, faded colours or other issues caused by environmental impacts are not covered by any warranties. In the event of a warranty, repairs will be carried out by BODY BIKE Australia. There will be no costs involved to you for any warranty repairs. 5 YEARS - Frame 3 YEARS - Crank 2 YEARS - Flywheel & Pulley, Manufacturing Defects, Loadcell / Brake unit / Control Box, Console 1 YEAR - Generator, Body Bike Australia 2 in 1 Pedals LIFETIME - Pedal Arms PEDAL WARRANTY Stuff wears out and needs to be replaced and maintained if you ride hard. Sometimes, things can even break. That's beyond our control in most cases. We can, however, guarantee that our pedals will be free from defects in manufacturing and design for a period of at least one year from date of purchase. But, please remember that high performance bike parts need to be serviced regularly and if you have an issue that arises from a lack of maintenance, then its not going to be covered by warranty if it breaks. In any case, Body Bike Australia Pty Ltd is not responsible for what you do with your indoor bike and we cannot be responsible for products which break when not serviced regularly or which have been used inconsistently with the product's design.
